Terms and Conditions of Sale

1. Ownership and Contracting Party

The website www.chateau-eclepens.ch is owned by Domaine du Château d’Eclépens Sàrl, a legal entity headquartered in Eclépens.

2. Scope of Application

By using the services and information offered on the online marketplace, the user agrees to these contractual provisions. All deliveries are exclusively subject to the current general terms and conditions. These apply to goods ordered by the user on the www.chateau-eclepens.ch platform via the Internet (online shop). This offer is only valid in Switzerland.

Items offered online, including descriptions and illustrations, are provided for information purposes only and are non-binding.

Château d’Eclépens reserves the right to adapt these general terms and conditions at any time and to apply them immediately.

3. Ordering Goods

Orders are placed online via the Internet order page. A sales contract is deemed concluded between the parties as soon as the platform confirms the order to the customer by email.

Goods can only be purchased if the item is physically in stock. If the operating company finds, after order confirmation, that the order cannot be delivered in full due to a stock shortage, it will notify the user and deduct the unavailable products from the final price. In this case, the customer is not entitled to damages.

Payment is made by credit card, direct debit card, via the Twint app, or by invoice. Once an order has been placed, it cannot be cancelled.

Château d’Eclépens reserves the right to limit the purchase quantities of certain products on www.chateau-eclepens.ch. Vintages are provided for information purposes only. Customers can inquire about the year of the wine by contacting our service department.

4. Delivery

Delivery is limited to Switzerland and Liechtenstein and is carried out by a trusted logistics provider. All items are delivered based on availability within 48 to 96 business hours to the address provided by the customer. A delay does not constitute grounds for order cancellation and does not entitle the customer to any compensation. Château d’Eclépens makes every effort to meet these delivery times.

Any delivery anomaly (damage, missing product compared to the delivery note, damaged package, broken product, etc.) must be reported to Château d’Eclépens by the buyer with proof of the anomaly.

Shipping costs are the responsibility of the customer and are charged as follows: CHF 20.00 for up to 11 bottles (75 cl). For 12 bottles (75 cl) or more, delivery is free throughout Switzerland.

Deliveries are only made after the order has been paid for.

Products may be delivered in their original packaging but may also be repackaged to allow for mixed orders or to ensure optimal delivery conditions.

5. Price and Payment

All prices are in Swiss francs, including all taxes, excluding delivery costs.

Ordered goods are paid for on the www.chateau-eclepens.ch website. Deliveries are only made after the order has been paid for.

6. Gift Vouchers and Promotional Codes

Gift vouchers and promotional codes may be issued by the Office des Vins Vaudois for the www.chateau-eclepens.ch platform. The total order value must be at least equal to the amount of the gift voucher or promotional code. No refund of residual value is possible. Furthermore, the value of the gift voucher or promotional code cannot be received in cash.

7. Copyright

All rights relating to the information, elements, and content of the online marketplace, in particular the images, names, and copyrights therein, are the property of Château d’Eclépens.

The reproduction, transmission, modification, and/or linking of this information for public and/or commercial purposes, in any form whatsoever, is expressly prohibited without the prior express written consent of Château d’Eclépens. Infringements will be subject to civil and criminal penalties.

8. Disputes and Return Policy

The customer has 7 days after the order to withdraw. In this case, they must expressly notify Château d’Eclépens. The order amount will be refunded within 3 days of cancellation. If the goods have already been sent to the customer, the customer shall bear the delivery costs (shipping + return of goods) as well as any actual additional costs.

Upon receipt of the goods, a customer who notices a defect has 3 days to notify the operating company. The following are considered defects:

  • A product not matching the order
  • An error on a label
  • A severely damaged label
  • A broken product
  • Cork taint

Once the notification has been given by the customer, they have 7 days to return the defective product to Château d’Eclépens. After this period, any return will be refused. Furthermore, a defective bottle of wine does not allow for the return of the entire order, but only the product concerned.

For a bottle with cork taint, it must be returned 3/4 full with the original cork to be replaced. The customer must notify Château d’Eclépens within 3 days of discovering the defect. Château d’Eclépens reserves the right to reject this defect if it is not confirmed by the producer.

Whenever possible, the product will be replaced by a standard exchange. If this is not possible, Château d’Eclépens will refund the customer the value of the defective product.

9. Sale of Alcoholic Beverages to Minors

In Switzerland, the purchase of wine is prohibited for persons under the age of 16. By ordering wine, the customer confirms that they are at least 16 years old and have read the general terms and conditions.

10. Privacy Policy

All private data of members registered on the www.chateau-eclepens.ch platform remains strictly confidential and is not used for commercial purposes other than those of Château d’Eclépens. However, the member agrees to receive advertising information from Château d’Eclépens.

Order data and contact details are recorded as part of account creation or order fulfillment as a “guest”, to process potential warranty cases, to improve the offer on the www.chateau-eclepens.ch platform, and to suggest products and offers to customers in accordance with our data protection policy.

Working with trusted shipping partners, this data is transmitted to these entities only during shipping and cannot be used by them for commercial purposes.

11. Applicable Law / Jurisdiction

Any dispute is exclusively subject to Swiss law. The place of jurisdiction is the seat of the competent court for Eclépens.
